ZConcious — Terms of Service

These Terms of Service ("Terms") govern your access to and use of the ZConcious application and website (collectively, the "Service"). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

If you are experiencing a medical or mental health emergency, stop reading and call 911 (or your local emergency number) or go to the nearest emergency room immediately. ZConcious is not a substitute for emergency services and cannot respond to crises.

1. Not Medical Advice — Important Health Disclosure

ZConcious is a self-guided productivity and mindfulness application. It is not a medical device, medical service, or healthcare product.

If you have — or think you may have — any medical, psychological, or psychiatric condition, please consult a qualified healthcare provider. Do not rely on ZConcious as a source of diagnosis, treatment, or care.

2. Emergency Situations

ZConcious is not a crisis service and does not monitor the content you enter. If you are experiencing any of the following, seek immediate help:

Call 911 (United States) or your country's emergency services number immediately. In the United States, you can also call or text 988 to reach the Suicide and Crisis Lifeline. Do not use ZConcious to seek help in an emergency.

3. Eligibility

You must be at least 13 years old to create an account and use the Service. If you are under 18, you must have permission from a parent or legal guardian. By creating an account, you represent that you meet these requirements.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly if you suspect unauthorized use of your account. You agree to provide accurate information during signup and to keep it current.

The journal entries, task lists, intentions, and other content you create in ZConcious ("Your Content") belong to you. By using the Service, you grant us a limited license to store, transmit, and display Your Content solely to operate the Service for you (for example, to sync it across your devices). We do not use Your Content for advertising, training AI models, or any purpose beyond operating the Service.

7. Our Content

The ZConcious application, its libraries of affirmations, visualizations, and journal prompts, its audio content, its branding, and all other materials we provide are owned by us or our licensors and are protected by copyright and other laws. You receive a personal, non-exclusive, non-transferable, revocable license to use them within the Service for your own personal, non-commercial use.

Our handling of your personal data is described in our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL SUCH WARRANTIES.

Without limiting the foregoing, we make no warranty that using the Service will produce any particular health, wellness, psychological, emotional, or productivity outcome.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL ZCONCIOUS, ITS OPERATORS, OR ITS LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

11. Indemnification

You agree to indemnify and hold harmless ZConcious and its operators from any claim or demand, including reasonable attorneys' fees, arising out of your breach of these Terms or your misuse of the Service.

12. Termination

You may stop using the Service and delete your account at any time by contacting us. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. On termination, the license we grant you ends, but provisions that by their nature should survive (including Sections 1, 2, 9, 10, and 11) will survive.

13. Changes

We may update these Terms from time to time. Material changes will be announced through the Service or by email. Your continued use of the Service after an update constitutes acceptance of the revised Terms. If you do not agree to an update, stop using the Service.

14. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction of those courts.
